Host Agreement

By publishing or hosting an experience on MyTrailPals, you agree to the following terms and responsibilities.
1. Relationship to Other MyTrailPals Policies
This Host Agreement supplements, and should be read together with, MyTrailPals' Terms of Service, Privacy Policy, and Pricing & Refunds page, each of which is incorporated into this Agreement by reference. In the event of a direct conflict between this Agreement and the Terms of Service specifically as to a Host's obligations, this Agreement controls.
2. Independent Host Status
You are independently organizing and leading your experience. You are not an employee, contractor, agent, partner, or representative of MyTrailPals. You are solely responsible for planning, organizing, and conducting your experience.
3. Accurate Experience Information
You agree to provide accurate and complete information regarding:
- •Activity description
- •Difficulty level
- •Meeting location
- •Duration
- •Physical requirements
- •Equipment requirements
- •Known risks and conditions
You will promptly update attendees if any material changes occur.
4. Safety Responsibilities
You are responsible for:
- •Assessing conditions before and during the experience
- •Conducting the experience in a reasonably safe manner
- •Making decisions regarding participant safety
- •Modifying or canceling activities when conditions become unsafe
- •Providing attendees with relevant safety information
5. Permits, Permissions, and Compliance
You are responsible for obtaining and maintaining any permits, permissions, licenses, certifications, insurance, or approvals required for your activity and location. You agree to comply with all applicable laws, regulations, and land-use requirements.
6. Communication
You agree to communicate promptly with attendees regarding:
- •Schedule changes
- •Meeting location updates
- •Weather-related changes
- •Safety concerns
- •Experience requirements
7. Respectful and Inclusive Conduct
You agree to foster a welcoming, respectful, and inclusive environment. Harassment, discrimination, intimidation, or unsafe behavior will not be tolerated.
8. Privacy and Participant Information
You may use attendee information solely for coordinating and conducting the experience. You may not sell, share, or misuse participant information.
9. Host Responsibility and Acknowledgment
You understand that MyTrailPals provides a platform that connects hosts and attendees. MyTrailPals does not supervise, direct, control, or manage the activities conducted by hosts.
10. Indemnification
You agree to indemnify, defend, and hold harmless MyTrailPals, its officers, directors, employees, and agents from any claim, damage, loss, or expense (including reasonable attorneys' fees) arising out of or related to: (a) your experience, including any injury, loss, or damage to an attendee or third party; (b) your breach of this Agreement or the Terms of Service; or (c) your violation of any law or third-party right. You remain solely responsible for your own actions and decisions while hosting, and for the overall operation of your experience.
11. Tax Responsibility
You are an independent contractor, not an employee of MyTrailPals, and are solely responsible for reporting and remitting any tax owed on income you earn through the Service, including any tax reporting obligations triggered by payouts you receive.
12. Consequences of Non-Compliance
MyTrailPals may request documentation supporting your compliance with this Agreement at any time, and may suspend or remove your listing, hosting privileges, or account if you violate this Agreement, misrepresent your compliance with it, or otherwise fail to meet the standards described here, consistent with the Terms of Service.
Host Acknowledgment
I have read and agreed to the MyTrailPals Host Agreement, and the Terms of Service, Privacy Policy, and Pricing & Refunds page incorporated into it, and understand my responsibilities as an Experience Host.
